Coronial Inquests & Coronial Investigations

Melbourne Criminal Lawyers Balot Reilly
462 William St Melbourne West VIC 3003

What is the Coroners Court?
In Victoria, the Coroners Act 2008 establishes the Coroners Court, which is charged with the responsibility of investigating the cause of certain deaths and fires.
All deaths in custody are subject to coronial investigation and inquests. A Coroner must hold an inquest if:

  • a person dies (unnatural causes) in custody or care
  • Where a person’s identity is unknown
  • if the Coroner suspects homicide and no one has been charged in relation to the death.
    .
    Balot Reilly criminal lawyers can provide experienced legal representation for;
  • families and also assisting to obtain answers or closure regarding the death of their loved one or
  • Defending the rights of suspects who are required to give evidence in coronial inquests.

    .
What happens in a Coronial Inquest hearing?
Coronial Inquests are heard and determined by a Coroner and the conduct of the proceeding is very different to any other court proceeding. An inquest is not a trial. The coroner will not make findings of guilt or apportion blame The Coroner’s role is to investigate the cause of deaths and fires and using the inquisitorial process to get to the truth. This is an effective system of uncovering the truth using a different process to the adversarial system adopted by the County Court or Supreme Court, where the judge’s role is one of an adjudicator not an investigator

Upon reviewing all the evidence the Coroner will write a finding, which may result in a recommendation being made to the Director of Public Prosecutions to pursue the prosecution of a suspect. At Balot Reilly Criminal Lawyers we can protect a suspect against self incrimination and/or legal support or alternatively assist the families of the deceased.

    Assisting families of the deceased
Balot Reilly Criminal Lawyers can represent families in the Coroner’s Court to find out more information behind a suspicious death. Balot Reilly Criminal Lawyers can advise and assist you with coronial inquests if your friend or relative has died in custody, in a car accident or in suspicious circumstances (etc..) in trying hard to obtain answers to your questions and getting closer to the true cause and circumstances of the death.

Assisting suspects in the death of the deceased
Balot Reilly Criminal Lawyers can also assist you if you have been summoned / subpoenaed to give evidence where your evidence might tend to incriminate you, because after all the Coroner can make recommendations to the Director of Public Prosecutions to prosecute you or others for the death of the person subject to the coronial investigation and inquest

It is important to contact our criminal lawyers in Melbourne for coronial inquests and coronial investigations to assist either the families of the deceased or alternatively suspects with a coronial investigation or a coronial inquest
